Medical Malpractice Lawyers In NYC

HIE, or hypoxic-ischemic encephalopathy, occurs when a person is deprived of oxygen for an extended period of time, starving the brain and causing damage to it and the central nervous system. HIE has a very high frequency of occurrence in newborns that can contract the condition under a doctor’s supervision, while in the hospital, or during childcare. Babies that acquire severe cases of HIE experience a mortality rate that reaches as high as 50 percent. Even if babies are fortunate enough to survive, 80 percent of them will end up struggling with severe developmental issues, mental retardation, or cerebral palsy.

HIE cases can occur through negligent physician care of the expecting mother, negligence concerning the care of the newborn infant in the hospital, or when the newborn infant is under the negligent care of nannies, babysitters, or day care workers. If your case involves medical negligence, then medical malpractice lawyers in NYC can help you obtain compensation. If your child contracted HIE while under the care of another individual or day care center, you can still gain damages through a NYC personal injury lawyer.

HIE normally causes brain damage which can leave your child suffering abnormalities for the rest of their lives as well as place a tremendous strain on you to provide both physical and financial care. You shouldn’t have to bear such a burden alone. Contact us for a consultation with a brain damaged baby lawyer NYC today and we will help you obtain as much compensation as the law allows. Receiving damages may not make your baby healthy, but it can go a long way towards ensuring they are properly cared for.

Were you recently in an accident

Have you checked for possible brain injury?

In New York City, there are a large number of vehicular accidents and other types of accidents that result in traumatic brain injuries. Unfortunately, all too often, a severe head injury goes unnoticed or improperly diagnosed because the victim does not receive a thorough examination after suffering injuries. Additionally, many symptoms of traumatic brain injuries do not often show up right away, and a settlement might have already been made with an insurance company before the victim realizes that they might have suffered more serious injuries than previously thought.

If you are in any type of accident where you suffered any kind of a blow to the head, no matter how slight, it is important to examine for possible brain injuries or head trauma. Additionally, you should also contact a New York brain injury lawyer, as they will help you secure a proper, thorough examination as well as compensation for any severe injuries you might have suffered.

A major benefit of retaining the services of a professional and experienced brain injury lawyer in NYC is that you are sure to receive compensation for lasting injuries and medical treatments that may require payments over the remainder of your life. Brain injuries can leave you with serious and debilitating symptoms for life, and a settlement with an insurance company is unlikely to properly compensate you for such an event. Remember, brain injuries are much more common than you might think—almost 2 million people each year suffer from traumatic brain injuries due to accidents. See a brain damage lawyer in NYC today if you have injuries to your head due to any type of accident.

What you can do if you become injured during a home remodel

In NYC, we often hear stories of construction workers injured on the job. But sometimes the homeowner, visitor or resident of a building is injured due to shoddy construction work. When such an accident occurs, it is extremely important to discover who is responsible for the construction work and how they might be liable for causing your injuries. Problems can arise if the contractor was unlicensed or uninsured.

As a homeowner, you can avoid such future problems by ensuring that you only hire contractors that are properly licensed and insured, for your own safety as well as that of the contractor. This is because a contractor injured while working on your home that is not insured might actually be able to sue you for damages. If an incident occurs where you are injured and you believe it is the fault of bad contractors, you need to contact a New York City construction accident lawyer right away.

A New York construction accident attorney is well versed in the rules and regulations regarding construction safety and guidelines, licensing and insurance, and will be able to investigate and discover any negligence on the part of the contractor that caused you or a loved one to sustain injuries.

Additionally, New York construction accident lawyers can usually get you a much larger settlement than the insurance companies might be willing to offer, including compensation for medical bills, pain and suffering, lost wages from missed work, and any additional treatment you might require in the future if the injuries need continual treatment or you have become disabled.

5 Common Personal Injuries to Avoid

Personal Injuries make up an enormous portion of the claims made upon insurance companies, and certainly serve to keep the best serious injury lawyers in NYC quite busy. Many personal injuries could be easily avoided if one would only take the time to make sure that certain safety precautions are followed or certain dangerous situations avoided if possible.

Some of the simplest personal injuries suffered by many in NYC that could be easily avoided include:

  • Trips and falls due to an unsafe walking environment, caused by things such as debris, or snow and ice.
  • Injuries caused by poorly maintained equipment or tools
  • When riding a bike or driving in a car, always be aware of other drivers and limit any possible distractions
  • Back injuries caused by not lifting things safely, with help, or with the proper equipment and safety procedures being followed
  • Injuries in and around the home caused by areas of neglect, such as electrical wiring that needs maintenance, falls off of ladders, not being safe when using gardening equipment, etc.

Regardless of the type of personal injury, if you or a loved one does happen to suffer such an injury, it is recommended that you contact a personal injury lawyer in NYC. Severe injuries can cause quite a drain on your finances, and can also lead to drastic changes in your lifestyle if the injuries are lasting or leave you disabled.

Settling things with insurance companies without legal representation will more often than not leave you with a settlement that does not provide you with nearly enough to even cover medical bills, let alone help you in the event that you will miss work or require continual medical help.

The top New York personal injury lawyers can help investigate on your behalf and see what they can do to ensure you get the compensation you require and deserve.

Recovering from Serious Injuries When it is Simply Part of Your Job

Some jobs are more dangerous than others. Police officers and Firemen are probably two such occupations that come to mind when thinking of dangerous jobs, especially in NYC. However, many other jobs also carry elements of danger and a great potential for injury that you might not have necessarily thought of. Health care workers happen to suffer more injuries than individuals in most other careers. Additionally, bouncers, security guards and bodyguards also risk injury and possibly even death every day on the job.

Brain Injuries are Often Times Life Altering Events

Injuries occur on the job every day, many of them are thankfully minor and do not require extensive treatment and rehabilitation. However, a brain injury is a completely different matter altogether. Brain injures frequently alter the course of a worker’s entire life. That’s why it is imperative that a brain injury lawyer in NYC be contacted for a consultation if you or a loved one ever suffers a brain injury.

Seeking brain injury compensation is not an easy task. As you might imagine, the monetary figure involved in treating such an injury and attempting rehabilitation can be quite large, and an insurance carrier won’t be so eager to pay such a large amount through a worker’s compensation claim.

Grieving family suing Murphy bed store over man’s death

New Yorkers have the privilege to live in a vibrant city, a place where people from all over the world come to live and work. Because our city is so dynamic, it often means we have to make do with smaller living quarters than in other locales — after all, there’s only so much real estate to go around.

Fortunately, there have been plenty of adaptations that creative folks have implemented to maximize the space that we do have. One of them is the Murphy bed. Even if you don’t have one yourself, you’ve likely seen one. It’s a bed that is concealed in a wall cabinet when not in use, allowing the use of more space in a small apartment or room.

Government can only do so much to rein in bad landlords

Tenants in New York City apartments have many resources they can seek out when they experience a problem with their apartment or their landlord. In some cases, injuries sustained in an apartment accident might lead to a tenant’s case being heard in court, and even a judgment against a landlord. However, some of those judgments might be all but unenforceable against a landlord who doesn’t have the means to pay them.

If it gets to the point where a landlord has to give up the property, that still might not solve the tenants’ problems. One example of this phenomenon comes to us from the Bronx, where the landlord so severely neglected his responsibilities that a judge in the city’s housing court actually sentenced him to a month behind bars — an almost unheard-of sentence in housing court.

Visitor to Bronx apartment hurt when staircase collapses

People in New York need to know that their apartment buildings are safe for them to live in. Everyone knows how expensive it can be to live here, and if a residential building is dangerous, it can make a bad situation for tenants even worse. Fortunately, many dangerous situations are never fully realized, but a recent accident at a Bronx apartment building shows what can happen when things go wrong.

The incident took place in an apartment building on East 166th Street. A staircase inside the building collapsed and injured a 20-year-old man, who was in the building to visit his sister. The man fell from the second floor down to the first floor through the stairwell. His injuries were not thought to be severe; however, as a result of the accident involving the faulty stairs, the building was evacuated.

Frost in apartments leads residents to file class-action lawsuit

New Yorkers who live in rented apartments are entitled to have certain expectations about their living situation. One of these expectations is that their apartment is habitable in the wintertime. This winter was a particularly difficult one for people in the Northeast and around much of the country, with excessive snowfall and bitter cold dominating the weather for months.

It’s with this in mind that several residents of an apartment building in Battery Park City have filed a lawsuit against the landlords and developers of their building. The tenants are seeking compensation because they say their units are so poorly built that frost accumulated on the inside of their apartments over the winter.

Midtown Manhattan construction worker falls to his death

It’s no secret that construction is a dangerous line of work. Even the most careful employees can suffer an accident, often through no fault of their own. With the large number of projects going on in Manhattan at any given time, and due to the tight spaces that they have to contend with, construction workers in New York face an especially difficult task to complete the jobs they’ve been assigned.

Last week in Manhattan, a worker fell eight stories to his death due to an apparent scaffold fall. Apparently, some planks of the scaffold had been removed, and the worker fell about 80 feet to another scaffold, directly above the building’s main entrance. The accident was witnessed by several people who could see the building, the Dream Hotel, from their vantage points in neighboring buildings.

Safety of communication towers around country in question

Communication towers are mainstays around the country. People in New York and everywhere around the U.S. expect to have a strong, reliable cellphone signal all the time, and as a result, communication towers — which rise hundreds of feet in the air — are in demand. That means that workers are needed to maintain and construct these towers. Unfortunately, this work can be quite dangerous.

The federal Occupational Safety and Health Administration issued a warning to the industry recently, indicating that several workers had been hurt by falling items, collapsing towers and other dangerous conditions at communication tower sites. In fact, last year there were 13 workers around the country who died in accidents at communication towers. That’s more than the total number of fatalities from 2011 and 2012 combined.

Disabled woman files lawsuit over New York apartment injury

We have written frequently in the past on our New York premises liability blog about how dangerous conditions in apartments can lead to tenant injuries. While it might seem unusual that someone could suffer an apartment injury because her domicile was too big — rather than being too small, poorly lit or in bad condition — but that’s just what a Brooklyn woman is claiming.

As a result of an injury she suffered from a fall in her Coney Island apartment, the woman is suing the New York City Housing Authority for $1 million. The woman is disabled and lives in a three-bedroom, two-floor apartment, which she says is too large for her. Every year for the last decade, the woman says she has completed a form sent to her by NYCHA that would have enabled her to move to a smaller unit. However, she says she never heard back from the agency.

Young girl falls into shaft of out-of-service apartment elevator

A young girl was listed in serious condition after falling into a New York City apartment building elevator shaft.  Members of the fire department had to pry open the basement elevator doors to rescue her.  She then had to be hoisted up in a basket to free her from the shaft.

The March 21 accident occurred in SoHo. It is not known if the girl was a resident of the apartment.  However, it has been reported that the elevator was out of service at the time the accident occurred.

Family still reeling, a year after crash killed father and son

It goes without saying that being in a serious car accident is one of the worst things that can happen to a family in New York. Injuries can linger for a long time among the survivors, who may be lucky to survive the accident at all. If it turns out that the accident may have been caused by another driver who was overserved at one or more drinking establishments, sorrow can easily turn to anger.

New York does have tavern liability laws in place — laws that allow third-party victims of drunk driving accidents to sue the bar, restaurant or tavern that overserved a patron involved if that patron was visibly intoxicated prior to the accident. These cases are especially important for families who have long-term effects as a result of being in such an accident.

Could landlords be deliberately sabotaging their properties?

It’s not an exaggeration to say that New Yorkers who rent apartments place a great deal of trust, out of necessity, in their landlords. After all, tenants depend on landlords to make sure that their apartment buildings are well-maintained and safe. Faulty stairs, tears in carpeting, the presence of lead paint, poor lighting, and failure to remove ice and snow from sidewalks are all examples of landlord negligence that could lead to apartment accidents.

Most of the time, these sorts of situations are just that: negligence. A landlord might not tear the carpet himself, but if he knows about torn carpet in the hallway of a building and then a tenant trips and falls on it, that landlord could be determined to be negligent.

New York City construction injuries up, but fatalities drop

As we have often discussed on our New York premises liability blog, having a job in the construction industry is often dangerous work. Due to the heavy machinery in use and the heights at which many workers must do their jobs, injuries from scaffold falls or other catastrophic events can be serious and lead to a lifetime of medical bills and rehabilitation expenses.

Rough winter makes for multiple hazards for Bronx residents

A bad winter can make life for New Yorkers more difficult in a number of ways. Extreme cold weather can be problematic for tenants whose landlords don’t ensure a constant supply of heat; snow and ice can turn regular sidewalks into slip-and-fall hazards for residents young and old.

It’s always better to prevent a slip-and-fall accident if you can

Slip-and-Fall Accident Prevention

As winter hits us in the Northeast with full force, sidewalks and paths that are otherwise unremarkable may suddenly become treacherous due to ice and snow. While a slip-and-fall accident can happen at any time of the year, the chances of such a thing happening would seem to increase when weather conditions are bad.

New technology could improve the quality of New York sidewalks

New Yorkers walk everywhere. On those miles and miles of sidewalks — more than 12,000 miles, in fact — accidents sometimes happen, particularly in the form of a trip and fall accident. Aside from fixing uneven pavement — or, in the wintertime, making sure the sidewalks are clear of snow and ice — it doesn’t seem like there’s much that can be done.

A Small Head Injury Can Become More Serious in Time. Did You Get the Compensation You Deserve?

NY Brain Injury Attorneys

Head trauma injuries can be extremely deceiving. Some head injury accidents cause the person to lose unconsciousness while others do not. Head blows, however severe, can damage the brain in various degrees. Many people appear to be fine after such an accident, performing and feeling normal.

Although a blow to the head may not seem serious at the time, worse symptoms can appear over days or even weeks often leaving the sufferer with high medical expenses, lost time from the job, or even hired care should they be incapacitated and unable to function on their own. For this reason, it is routinely recommended by health professionals that victims of head injuries seek council from a personal injury lawyer in the event that symptoms worsen and lifestyles are interrupted. Legal counsel will consider such questions as: Was it an on-the-job injury? What were the surrounding circumstances leading to the injury? Was negligence involved? What insurance options does the victim have? Who can make financial and medical decisions for the victim if they become incapable?

Because the brain is extremely complex, head injuries that seem to be mild could turn into debilitating experiences after the event has passed. It is extremely prudent to seek legal counsel from NY attorneys specializing in personal injury law if you or a loved one are involved in a head injury accident, regardless of how you feel. Having NY personal injury attorneys in your corner in such an event could save you a great deal of worry, suffering and expense.

Head Trauma Can Lead to Serious Injuries: Don’t Settle for Low Compensation

That’s why it’s especially important to contact a brain injury lawyer in NYC if you or a loved one is ever involved in an accident where there were injuries to the head.

But whenever there is a head injury, no matter how slight it may appear, it is important to have a full range of tests done to see not just what ailments you may be suffering from now, but also what injuries or ailments you might be suffering in the future due to the head trauma.

After retaining the services of a NYC brain injury lawyer, you’ll find that your chances for greater compensation have increased. That’s because your personal injury attorney will fight for you on your behalf to ensure you get all the compensation you deserve, for your injuries suffered as a result of the accident as well as what might befall you in the future.
